You refused the breath test? Well, that actually is an automatic suspension of your license for a year by the DMV. So maybe he/she can get that reduced, or help you get a hardship license, and this all must be requested within 10 days including weekends, from the date you were cited. And it has to be a request made to the state DMV and there is an additional hearing fee for that. It’s separate from the courts and it is not dependent on your guilt. If you refuse the test, you give up your driving privileges. They make you sign an agreement to that when you get your license. So he/she can help you get things like that taken care of, and if the lawyer has pull, he/she may be able to work out a plea bargain deal with the DA’s office, or get you diversion instead, or if you have a winnable case, he/she could take it to trial. But it depends on a lot of things, and the only way you can even know what type of options you might have, is to hire a lawyer.
With the circumstances you described a lawyer is a definite requirement.
I don’t think the 5th amendment to the US Constitution applies to being asked to take an alcohol breath test, in fact I’m sure it doesn’t. In most states, when you are given a driving license you swear that you will abide by all state laws and one of them requires you to submit to an alcohol test if requested by the police while driving a vehicle. Go get a copy of the driver’s manual for your state and look it up. It’s easy to find.
A lawyer can do whatever there is to be done to protect your rights under whatever the circumstances were. Might keep you out of jail or get you a lighter sentence.
What is "suspended registration" anyway? I have heard of suspended license, but not registration. Registrations usually only expire – they are not suspended. If you were driving on a suspended license, that is a crime. If you were also under the influence at the same time, I would get a lawyer if I were you, or an iron clad chastity belt to wear to prison. You seem to think that laws do not apply to you, so please stay off the road until you grow up and accept some responsibility. We really don’t need any more problems in America right now, so man up and become part of the solution instead part of the problem.
